These Terms of Use (the “Terms”) govern your use of the PWB (Pilot Weather Brief) iOS application (the “app”), provided by Andrew Logie (“we”, “us”). Please read them carefully before using the app.
PWB is an informational and situational-awareness tool only. It is not certified or approved by the Civil Aviation Authority, the Federal Aviation Administration, EASA or any other civil aviation authority, and it must not be used as a primary source for flight planning, dispatch, navigation, or in-flight decision making. Always obtain an official pre-flight briefing from an approved source.
1. Acceptance of these Terms
By downloading, installing or using the app you agree to these Terms. If you do not agree to them, please do not use the app. When you first launch the app you will be asked to confirm that you understand the limitations described here.
2. Informational use only
The app displays aviation weather information, including METARs, TAFs, SIGMETs and related airport data, together with decoded interpretations of that information. It is intended to support your general awareness of weather conditions. It is not an approved source of aeronautical information and is not a substitute for an official briefing, for consultation with air traffic services, or for any other source approved by the relevant aviation authority.
The app is not certified under any airworthiness, avionics or software assurance standard, and no representation is made that it meets any such standard.
3. No warranty as to accuracy, completeness or timeliness
The app and all information within it are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no representations or warranties of any kind, whether express or implied, about the app or its content.
In particular, we do not warrant that:
- weather information is accurate, current, complete or free from error;
- reports and forecasts will be received, decoded or displayed correctly, or at all;
- information will be delivered without delay, interruption or omission;
- the app will be available at any particular time, or will be free of defects.
Aviation weather data may be delayed, superseded, amended or withdrawn at short notice. Decoded and summarised information is generated automatically and may misinterpret the underlying report. You should always cross-check the raw report and consult official sources.
4. Third-party data
Weather and airport information shown in the app is obtained from third-party sources, principally the NOAA / NWS Aviation Weather Center (aviationweather.gov). Mapping is provided by Apple Maps. We do not control these services, do not verify the information they provide, and are not responsible for their accuracy, availability or content. Your use of information originating from those services may also be subject to their own terms.
5. Your responsibility as pilot in command
If you are involved in the operation of an aircraft, you remain solely responsible for the safe conduct of the flight and for all decisions relating to it. This includes obtaining a lawful and adequate pre-flight briefing from official sources, complying with all applicable regulations and procedures, and independently verifying any information you have seen in the app before relying on it. Nothing in the app relieves you of those responsibilities.
6. Acceptable use
You agree to use the app only for lawful purposes, and not to: copy, modify, reverse engineer, decompile or attempt to derive the source code of the app except to the extent permitted by law; resell or redistribute the app or its content; or use the app in any way that places an unreasonable load on, or interferes with, the app or any data source it relies upon.
7. Limitation of liability
To the fullest extent permitted by law, we shall not be liable for any loss or damage, whether arising in contract, delict (tort), negligence, breach of statutory duty or otherwise, that arises out of or in connection with your use of, or inability to use, the app or any reliance placed on information within it. This includes, without limitation, any indirect or consequential loss, loss of profit, loss of opportunity, or loss or damage arising from inaccurate, incomplete, delayed or unavailable information.
Some liability cannot be excluded by law — including liability for death or personal injury caused by negligence, and for fraud. Nothing in these Terms affects those rights, or your statutory rights as a consumer.
8. Indemnity
You agree to indemnify us against any claims, losses, liabilities and reasonable costs arising from your misuse of the app or your breach of these Terms, except to the extent that such claims arise from our own negligence or breach of these Terms.
9. Purchases
Where the app is offered for a fee, or offers optional in-app purchases or subscriptions, those transactions are processed by Apple through the App Store and are subject to Apple’s terms and refund policies. We do not process or store your payment details. Any purchase terms, prices and renewal conditions will be shown to you before you confirm a purchase.
10. Changes to the app and to these Terms
We may update, change or discontinue the app or any of its features at any time. We may also update these Terms; the current version will always be published at this address with a revised “last updated” date. Where changes are material, you may be asked to acknowledge them again within the app. Continuing to use the app after a change takes effect means you accept the revised Terms.
11. Governing law and jurisdiction
These Terms and any dispute or claim arising out of or in connection with them are governed by the law of Scotland. The Scottish courts shall have jurisdiction, save that if you are a consumer resident elsewhere in the United Kingdom you may also bring proceedings in the courts of the part of the UK in which you live.
12. Severability and entire agreement
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with the Privacy Policy, form the entire agreement between you and us in relation to the app.
